We cover: 1) Lying to Fed Charge Ensnares Whale Watchers - Title 18 Section 1001 makes it a crime to make a material false statement in matters of federal jurisdiction. When whale watchers whistled at whales they may have harassed them and the video tape provided to NOAA was edited. Critics charge that the 1001 law is vague and subject to abuse. 2) Constitutional Corner - SCOTUS hears Arizona's immigration law ( SB-1070). Solicitor General Verrilli argues that Arizona is overstepping its bounds when officers make a records check on the legal status of a person stopped for other reasons, and then informing the federal government. But Justice Sonia Sotomayor told Verrilli, "You can see it's not selling very well." 3) EPA Head in Hot Water - A top EPA official has apologized for comparing his agency's enforcement strategy to Roman crucifixion.
Al Armendariz, the EPA administrator in the Region 6 Dallas office, who linked hydraulic fracturing to water contamination, said the Romans would "find the first five guys they saw, and they'd crucify them." Critics charge he unfairly targeted oil companies.
